HYPESPARK PRIVACY POLICY

 

Introduction

HypeSpark, LLC (“HypeSpark”) takes your privacy seriously. HypeSpark pledges to follow the provisions of this Privacy Policy in order to protect your privacy rights.

This Privacy Policy (this “Policy”) outlines HypeSpark’s general policy and practices for protecting your information. It includes the types of information HypeSpark gathers, how it is used, and the choices you have regarding HypeSpark’s use of their information. This Policy applies to all personal and non-personal information received by HypeSpark whether in electronic, written, or verbal format.

HypeSpark reserves the right to modify this Policy at any time and will do so from time to time. 1. Scope

This Policy covers the entire Site. However, it does not apply to entities that HypeSpark does not own or control including, affiliates, advertisers, or developers of content. It also does not cover non-HypeSpark sites or links generated through the Site. These entities are governed by their own privacy policies and not this Policy. Please check the privacy policy of any entity you interact with on or off the Site.

2. Information HypeSpark Collects About You

Any time a guest or users accesses the Site they receive a “cookie” from HypeSpark. HypeSpark uses cookies (small pieces of data stored for an extended period of time on a computer, mobile phone, or other device) to make the Site easier to use and to protect both you and HypeSpark. These cookies give HypeSpark information about your use of the Site. 3. Information You Provide to HypeSpark

As part of the process to become a member, HypeSpark requires you to provide your name, age, and email address. Other information can be provided but is voluntary and includes, but is not limited to, [address, phone number, place of employment, number of people in household, gender, etc].

While using the Site you may provide, including, but not limited to, links, location data, files, documents, text, photographs, images, audio, video, and any materials accessed through or made available for use or download (collectively “Content”) to HypeSpark by uploading, posting, or publishing the Content on or through the Site. Frequently, Content you place on or through the Site will contain your name and a picture of your face. Some of this Content is placed in a public forum. Any information in a public forum is accessible by anyone, including people who are not users. Please keep this in mind when posting Content.

HypeSpark may also ask you about your shopping habits, including the stores you frequent and the brands you prefer. This information will also be collected automatically as you use the Site. HypeSpark may also collect information from advertisements you click on when using the Site. HypeSpark may also keep track of links you click on emails you receive from HypeSpark. This is done to increase the relevancy of the advertisements and offers you see.

You may also interact directly with other users. Please be aware they may share information you give them with other users you may not know. They may also share the information outside of the Site without your prior approval. HypeSpark does not have control over the actions of its users and accepts no responsibility or liability for their actions. Please keep this fact in mind when using the Site.

4. How HypeSpark Uses Your Personal Information

4.1 Location Information

HypeSpark may share information about your physical location to other users and the public. However, the site will only share your city and state but not your exact location.

HypeSpark is not responsible for any person’s actions that result from the sharing of location information. Furthermore HypeSpark is not liable for any damages to any persons or property which may result from sharing location information. You should use caution and common sense to prevent misuse of location information.

4.2 Age

HypeSpark uses the information you provide to ensure you are over the age of thirteen (13). The Site is not meant to be used by anyone under the age of thirteen (13). HypeSpark may also use your age information to be sure you receive an age appropriate experience while using the Site. If you think someone has submitted information from someone under thirteen (13), contact HypeSpark as soon as possible to have the information removed.

4.3 Personalized Advertisements and Offers

HypeSpark may use your information to serve you personalized advertisements or offers. HypeSpark allows advertisers and vendors to choose the characteristics of users who are presented with their advertisements or offers. HypeSpark may use any of your non-personally identifiable attributes to select the appropriate advertisements and offers you see. HypeSpark will never reveal personally identifiable information to advertisers or vendors. You may see the criteria advertisers or vendors may select by visiting HypeSpark’s advertising page. When you interact with advertisements or offers there is a possibility that you may receive a cookie from the advertiser or vendor to ensure that it meets the criteria they selected.

4.4 Information Used for Customer Support

HypeSpark will use the information it collects to provide services to you. HypeSpark will also use information about you to measure and improve the Site, and to provide you with customer support.

HypeSpark may contact you with service-related announcements from time to time. You may opt-out of all communications except essential updates. HypeSpark may include Content in the emails it sends you.

4.5 Other Use of Information

HypeSpark may use information about you that it collects from other users or it collects from the public domain to supplement information in your account. Furthermore, HypeSpark allows other users to use contact information they have about you to find you, such as your email address. 5. How HypeSpark Shares Your Information

HypeSpark shares your information with third parties when it believes the sharing is permitted by you, reasonably necessary to offer HypeSpark’s services, or when legally required to do so. HypeSpark will not share your information with third parties in a way that violates your privacy. The following are examples of the ways HypeSpark shares your information. However, this list is informative, not exhaustive.

When you invite a friend to join the Site, the invitation will contain information
that will allow your friend to identify you. The invitation may contain information about other users your friend might know.

Certain information you provide to HypeSpark will be shared by using
the Site’s search function. This allows other users to locate your profile and it allows new users to find people they know.

HypeSpark provides some public information to search engines. This information
allows search engines to locate the Site. It also allows people to locate you on the Site using a major search engine. This does not mean all information you post on the Site may be accessed using a search engine.

HypeSpark may provide information to third parties based on your interaction
with them. This access will only be sufficient to conclude the interaction. This is meant to allow you to participate in promotions, sales, discounts, contests, sweepstakes, or any other special offer advertisers or vendors extend to you.

HypeSpark may also share information when HypeSpark has a good faith belief it is necessary to prevent fraud or other illegal activity, to prevent imminent bodily harm, or to protect HypeSpark and you from people violating the Terms of Use [insert hyperlink to Terms of Use] of the Site. HypeSpark may disclose information pursuant to subpoenas, court orders, or
other requests (including criminal and civil matters) if HypeSpark has a good faith belief that the response is required by law. This may include requests from jurisdictions outside of the United States if HypeSpark has a good faith belief that the response is required by law under the local laws in that jurisdiction, is applicable to users from that jurisdiction, and is consistent with generally accepted international standards.

HypeSpark may disclose analyzed data in the form of purchasing trends or
statistical data. No personally identifiable information will be attached to this disclosure.

6. Business or Asset Transfer or Sale>

HypeSpark may be sold, might sell or buy businesses or assets of businesses, or HypeSpark might merge with another business. In such transactions, personal information is generally one of the transferred business assets. Also, in the event that HypeSpark, a line of business of HypeSpark, or substantially all the assets of HypeSpark are transferred, user information may well be one of the transferred assets. HypeSpark will make a reasonable effort to provide notice on the Site, and to notify you via email, to the most recent email address that you have provided to HypeSpark, of any such change in ownership or control of your personal information.

HypeSpark has in place appropriate physical, electronic, and managerial procedures to safeguard and secure personal information. HypeSpark cannot guarantee the security of information on or transmitted via the Internet.

HypeSpark shall only process personal information in a way that is compatible with and relevant to the purpose for which it was collected or has been authorized. To the extent necessary for those purposes, HypeSpark shall take reasonable steps to ensure that personal information is accurate, complete, current, and reliable for its intended use.
